MCKINNEY, Texas, January 25, 2012–/PRNewswire/–A Texas State Court in Collin County local doctor has given more than $ 700,000 in attorneys ‘ fees and related costs as part of a long, ongoing legal battle over allegations of non-competition agreements between pathologists and former employers.

Judge Don Jarvis, sitting in the District Court in McKinney, 199th issued a ruling in Steven Hebert MD v. AmeriPath, Inc. No. 199-03680-2009.

AmeriPath, Inc., owned by New Jersey-based Quest Diagnostics, was ordered to compensate for Dr. Steven Hebert after the Court found that non-competition agreement AmeriPath’s with Dr. Hebert is truly entered the corporate entity has ever been legally established. Further, the Court found that attempting to enforce the Covenant AmeriPath while knowing that it does not apply to Dr. Hebert worked at HCA-affiliated Medical Center of McKinney.

Dr. Hebert’s lawsuit against his company AmeriPath and one for defamation, tortious interference and negligent misrepresentation would continue, though no trial date has been set. The judge earlier refused all AmeriPath’s Jarvis claims against Dr. Hebert arising from he resigned from his work continued in AmeriPath and hospital McKinney.
